US Court Mandates Release of Abrego Garcia from ICE Detention
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.
The situation originates in a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. After his return to the United States to answer human smuggling allegations, he was detained in immigration detention.
In her decision, the judge noted that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."
